from a first look:

I don't think V_GRAPH has a trademark on the name, but look for yourself.
http://www.uspto.gov/web/menu/tm.html

Googling for "ozone" and "v_graph", there are nearly no results at all.
If you compare that to a search for "ozone" and "smb", it is clearly
visible, who uses the name.

I am not a lawyer but I know there is something like a right of first usage.
If you look at this site, it is possible that V_GRAPH has been using the
name since 1996.
