I'm not a lawyer, so everything I say should be taken with a grain of salt.
One of those big Kosher grains they like so much on cooking shows. :)
I would recommend entering a dialog with this guy and seeing if he feels a
moderate change to Ozone's name (say to OzoneDB) would satisfy him.
Personally, I think it would take a very careless person to mix the two products
up (one being an open source database and the other a RAD tool). However, there are
very expensive lawsuits that are fought over stuff like this. And usually, the one
with the most expensive lawyer wins....
